Welcome to Skin & Pixel Lab. These Terms of Service (hereinafter "the Terms") govern access to and use of the professional 3D simulation platform for aestheticians available at xkinlab.com (hereinafter "the Service"), operated by Skin & Pixel Lab S.A.S. (hereinafter "we", "the Company"). By using the Service you agree to be legally bound by these Terms.

4.1 Free trial plan

We offer a free trial plan that includes 2 total simulations at no cost and without requiring a credit card. Upon reaching the simulation limit or after 30 days from registration, you must purchase a paid plan to continue using the Service.

4.2 Paid plans

Paid plans (Starter, Professional, Studio) include different levels of simulations, features and support. Prices and features of each plan are available at xkinlab.com/#pricing.

Prices are charged in USD. They may be displayed in local currency for informational purposes, but actual billing is processed in USD through our payment gateways.

Subscriptions automatically renew at the end of each monthly period until you cancel. You can cancel at any time from your settings panel.

4.3 Refund policy

Once a payment for any plan is processed, no refunds are granted. This includes monthly subscription payments, annual subscription payments, and any other payment modality offered.

Users are provided with a free trial period (TRIAL) before any payment. This period is the opportunity to fully evaluate the Service — its tools, quality of results, compatibility with the user's workflow, and fulfillment of expectations. By completing a payment, the user confirms that this evaluation has been performed and accepts the Service in its current state.

The only recognized exceptions are: (a) duplicate charges due to technical error attributable to the Service or the payment processor; (b) serious technical failure of the Service that prevents essential use for an extended period and has not been resolved within a reasonable time; (c) when local law applicable to the user mandatorily provides otherwise.

In the event of a dispute or chargeback initiated with the issuing bank of the payment method, the user's account may be suspended until the dispute is resolved. If the dispute results in funds being returned to the user, any credits generated from that payment (including those obtained through the referral program) will be reverted.

For cases the user considers covered by any of the foregoing exceptions, a formal complaint (PQRS) must be filed through the channel available within the Service, within thirty (30) calendar days from the date of charge, with details of the situation and supporting documentation.

All software, source code, design, trademarks, logos and content of the platform are exclusive property of Skin & Pixel Lab S.A.S. or its licensors and are protected by intellectual property laws.

The photographs and clinical data you upload to the platform remain your property (or your client's, as applicable). By uploading them, you grant us a limited, non-exclusive license to process, store and display them solely for the purpose of providing the Service.

The processing of personal data is governed by our Privacy Policy available at xkinlab.com/privacy, which is an integral part of these Terms.

8. Limitation of liability

The Service is offered "as is" without express or implied warranties. Skin & Pixel Lab does not guarantee:

Simulations are decision-support and professional communication tools. The professional aesthetician is solely responsible for the technical decision and the actual procedure performed on the client.

To the maximum extent permitted by law, our total aggregate liability for any claim related to the Service is limited to the amount paid by you in the 12 months prior to the event giving rise to the claim.

10. Modifications

We reserve the right to modify these Terms at any time. Material modifications will be notified at least 30 days in advance. Continued use of the Service after the changes take effect constitutes acceptance thereof.

11. Applicable law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any controversy arising from these Terms will be submitted to the jurisdiction of the competent courts of Medellín, Colombia, unless applicable law provides otherwise.
